By accessing or using the InnerMind website, creating an account, or using any of our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use InnerMind.

2. Description of Service

InnerMind is an AI-powered business intelligence platform that allows users to connect and upload operational, financial, and growth data to receive strategic insights, recommendations, and forward-looking guidance. InnerMind is generally available as a paid subscription and remains in active development, so features, availability, and pricing may change as the platform evolves. Material changes to pricing will be communicated with reasonable notice.

3. Beta Disclaimer

The Service is currently provided as a beta version and is made available for testing, evaluation, and continued development. The Service may contain errors, bugs, defects, security vulnerabilities, or other limitations, and features or functionality may change, be suspended, or be discontinued as we continue to develop the Service.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis during the beta period. To the maximum extent permitted by applicable law, we disclaim all warranties, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or available at any particular time, or that any particular feature or functionality will remain available. We may modify, restrict, suspend, or discontinue any part of the Service at any time as necessary to develop, maintain, improve, or secure the Service.

Use of the beta Service does not grant you any ownership, license, intellectual property rights, or other rights in or to the Service, its software, technology, algorithms, models, features, content, or other materials, except for the limited right to access and use the Service as expressly permitted under these Terms. Your participation in the beta program does not create any expectation or entitlement to continued access to the Service, any particular feature, or any future product, service, or functionality.

Your use of the beta Service is at your own risk. You acknowledge that the beta Service is not a finished product and that you should maintain appropriate backups and business continuity measures for any Customer Data or other information submitted to or generated through the Service.

Nothing in this Beta Disclaimer limits any express obligations we have under these Terms regarding the protection of Customer Data, security incidents, confidentiality, or other obligations that cannot be disclaimed under applicable law.

4. Accounts, Trials & Access

• Accounts are opened on a self-serve basis, and each new account begins with a 30-day trial of the Pro plan before any charge is made.
• InnerMind reserves the right to grant, decline, suspend, or withdraw access at its sole discretion.
• Some features are released progressively and may be labelled beta; those features may change or be withdrawn.
• Accounts and subscriptions are not transferable without our written consent.

5. User Accounts

When you create an account with InnerMind, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. InnerMind will not be liable for any losses arising from unauthorized use of your account.

6. Acceptable Use

You agree not to use InnerMind to:

• Upload data that you do not have the legal right to share or process
• Attempt to reverse engineer, decompile, or extract the underlying AI models or algorithms
• Use the platform for any unlawful purpose or in violation of any applicable regulations
• Transmit any malicious code, viruses, or disruptive data
• Resell, sublicense, or commercialize access to the platform without written consent from InnerMind
• Interfere with or disrupt the integrity or performance of the platform

7. Your Data & Content

You retain full ownership of any data you upload to InnerMind. By uploading data, you grant InnerMind a limited, non-exclusive license to process that data solely for the purpose of delivering insights and services to you. InnerMind does not claim ownership of your data and will not use it for any purpose outside of providing the service. You are solely responsible for ensuring you have the right to upload and process the data you provide.

8. AI-Generated Insights

InnerMind uses artificial intelligence to generate business insights and recommendations. These insights are provided for informational purposes only and do not constitute financial, legal, accounting, or professional advice. You should not rely solely on AI-generated insights when making business decisions. InnerMind is not liable for any decisions made based on information provided by the platform.

9. Intellectual Property

All content, branding, software, and technology on the InnerMind platform, including but not limited to the InnerMind name, logo, AI models, and user interface, are the exclusive property of InnerMind and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our platform without express written permission.

10. Subscription & Payment

• InnerMind is offered on paid subscription plans at the prices shown when you subscribe, billed monthly or annually through our payment processor. You may change plan or cancel at any time.
• All fees are non-refundable except as set out in our Refund Policy, which governs trials, cancellations, and refunds.
• InnerMind reserves the right to change pricing at any time with reasonable notice.
• Failure to pay applicable fees may result in suspension or termination of your account.

11. Termination

InnerMind reserves the right to suspend or terminate your access to the platform at any time, with or without notice, for conduct that violates these terms or is otherwise harmful to other users, InnerMind, or third parties. Upon termination, your right to use the platform will immediately cease. You may request deletion of your data as outlined in our Privacy Policy.

12. Disclaimer of Warranties

InnerMind is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, InnerMind disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, InnerMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the platform, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to InnerMind in the three months prior to the claim.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
